Terms and Conditions of Use

These Terms and Conditions (“Terms”) govern the use of this website and all services provided by New England Carpet Cleaning (“Company,” “we,” “us,” or “our”).

By contacting us, requesting service, scheduling an appointment, or using this website, you agree to be bound by these Terms.

 

 1.⁠ ⁠Scope of Services

New England Carpet Cleaning is a professional cleaning and restoration service provider offering residential and commercial services, including but not limited to:
•Carpet Cleaning
•Upholstery Cleaning
•Water Damage Restoration
•Air Duct Cleaning
•Dryer Vent Cleaning
 
All services are performed on-site at the customer’s property.
 
Service availability, response time, pricing, and scope of work may vary depending on location, technician availability, time of service, weather conditions, traffic, equipment requirements, and job complexity.
 
Any stated arrival times are estimates only and are not guaranteed.
 

 2.⁠ ⁠Estimates & Pricing

Any price estimates provided via phone, text, email, or online are non-binding preliminary estimates.

Final pricing is determined on-site after inspection and evaluation of the area, materials, level of contamination, damage severity, or service requirements.

By authorizing work to begin, the customer agrees to the final on-site price.

Emergency services, after-hours appointments, weekend service, holiday service, heavily soiled areas, stain treatments, structural drying, specialty fabrics, or restoration services may incur additional charges

 3.⁠ ⁠Authorization to Perform Work

The customer represents and warrants that they are the property owner or authorized agent for the property requiring service.

By requesting service, the customer authorizes New England Carpet Cleaning to perform the requested services and to take reasonable steps necessary to complete the job, including moving light furniture or equipment when appropriate.

We reserve the right to request proof of ownership or authorization prior to performing certain restoration or emergency services.

 

 4.⁠ ⁠Cancellation Policy

Appointments may be canceled without charge prior to technician dispatch.

Once a technician has been dispatched or arrives on-site, a service call and/or dispatch fee may apply, regardless of whether services are performed.

Special order equipment rentals, drying equipment placement, or restoration services already initiated may not be cancelable.

 

 5.⁠ ⁠Payment Terms

Payment is due immediately upon completion of service unless otherwise agreed in writing.

Accepted payment methods may include cash, credit card, debit card, or other approved methods.

All sales are final once services are rendered. No refunds will be issued except where required by applicable law.

Failure to remit payment may result in collection efforts, including recovery of reasonable collection costs, attorney fees, and court costs as permitted by law.

 6.⁠ ⁠Limited Warranty & Disclaimer

New England Carpet Cleaning may provide a limited workmanship warranty where applicable.

Manufacturer warranties apply to parts or equipment when provided.

Except as expressly stated:

•⁠ ⁠All services are provided “AS IS.”
•⁠ ⁠We do not guarantee complete stain removal, full restoration of damaged materials, or exact color matching.
•⁠ ⁠We disclaim all other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Results may vary depending on fiber type, age, prior damage, contamination level, and previous cleaning attempts.

 

 7.⁠ ⁠Limitation of Liability

To the maximum extent permitted by law:

•⁠ ⁠New England Carpet Cleaning shall not be liable for indirect, incidental, consequential, special, or punitive damages.
•⁠ ⁠Total liability shall not exceed the amount paid for the specific service rendered.
•⁠ ⁠We are not responsible for pre-existing damage, worn fibers, structural deterioration, subfloor damage, mold growth that existed prior to service, or issues caused by previous improper installations or repairs.

 8.⁠ ⁠Customer Responsibilities

The customer agrees to:

•⁠ ⁠Provide safe, lawful, and unobstructed access to the service area.
•⁠ ⁠Ensure electricity and water access when required.
•⁠ ⁠Secure pets, valuables, and fragile items.
•⁠ ⁠Inform technicians of any known damage, leaks, structural issues, or prior restoration attempts.

We are not responsible for delays or inability to perform services due to unsafe, inaccessible, or non-compliant conditions.

 

 9.⁠ ⁠Water Damage & Drying Services

For water damage restoration services:

•⁠ ⁠The customer understands that structural drying times vary.
•⁠ ⁠Mold growth can occur if moisture is not addressed promptly.
•⁠ ⁠Monitoring visits may be required to complete drying.

Insurance coordination, when provided, does not guarantee coverage approval.

10.⁠ ⁠Communications Conse

By providing your contact information, you consent to be contacted by phone, SMS, or email regarding your service request, appointment confirmations, updates, invoices, or follow-up communications.

Message and data rates may apply.

11.⁠ ⁠Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

Any legal action shall be brought exclusively in the state or federal courts located within Massachusetts.

12.⁠ ⁠Severability


If any provision of these Terms is found unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

13.⁠ ⁠Entire Agreemen

These Terms constitute the entire agreement between the customer and New England Carpet Cleaning regarding services provided and supersede all prior communications or representations unless expressly agreed in writing.
